In your letter 0.5557 of Lecember 6th, 1911, was enclosed
a rovised Counter-Draft of the Convention which it is pro-
posod to conclude between this country and Japan for the
mutual protection of patents, trade-marks, and designs in
China.
In the final paragraph of that latter, the Board of
Trade assumed that it would be possible to vost His Majesty'a
Consular Courts in China with power to apply the provisions of
Article 2 of the revised Counter-Draft in respect of un-
registered carks by Order in Council.
I am directed by Secretary Sir H. Grøy to say that
jurisdiction to protect unregistered trade marks in Chine can
be conferred upon His Majesty's Consular Courts in China,
provided that those Courts have not already got such juris-
